Important notice: INeedHelp is a private communication and coordination platform. It is not a public emergency service, medical service, police dispatch system, fire brigade service, rescue coordination center, or a substitute for official emergency channels.

If you are in immediate danger or face a life- or health-threatening emergency, contact your local emergency services immediately.

1. Acceptance of these Terms

These Terms of Service ("Terms") govern your access to and use of the INeedHelp mobile applications, websites, APIs, and related services (collectively, the "Service").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

If you use the Service on behalf of an organization, group, or other entity, you represent that you are authorized to bind that entity to these Terms.

2. Eligibility

You may use the Service only if you can legally enter into a binding agreement under applicable law. If you are under the age required by the laws of your country to consent on your own, you may use the Service only with any consent or authorization required by applicable law.

3. Description of the Service

INeedHelp is designed to help users communicate incidents, requests for assistance, and safety-related notifications to selected contacts, groups, volunteers, coordinators, or, where enabled, potentially relevant nearby users.

The Service may include account registration, geolocation-based incident reporting, group coordination, realtime notifications, messaging, attachments, and administrative moderation features.

4. Not an emergency service

INeedHelp does not guarantee that any person will receive, view, accept, respond to, or act on any incident, notification, or request for help.

The Service does not monitor all incidents in real time and does not guarantee dispatch, rescue, intervention, medical assistance, or any minimum response time.

You must maintain your own backup safety plan, including emergency numbers, alternative contacts, and fallback communication methods.

5. Availability and changes to the Service

We may modify, update, suspend, or discontinue all or any part of the Service at any time, with or without notice, to the extent permitted by applicable law.

We do not guarantee uninterrupted or error-free operation. Delays, outages, degraded performance, failed notifications, failed message delivery, GPS inaccuracies, mobile OS restrictions, device issues, and third-party network failures may occur.

6. Accounts and security

You may need to create an account to use some features. You agree to provide accurate, current, and complete information and to keep it updated.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account, unless such activity is caused by our failure to use appropriate safeguards.

You must notify us promptly if you believe your account has been accessed without authorization.

7. User content and incident submissions

You may submit content to the Service, including incident descriptions, messages, profile information, location data, photos, recordings, and other materials ("User Content").

You retain your rights in your User Content. However, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, adapt, transmit, display, and otherwise use your User Content solely to operate, secure, improve, moderate, and provide the Service, and to comply with legal obligations.

You represent and warrant that:

  • you have the rights and permissions necessary to submit the User Content;
  • your User Content is accurate to the best of your knowledge;
  • your User Content does not violate any law or third-party rights.

8. Acceptable use

You agree not to:

  • submit false, misleading, fraudulent, or malicious incidents;
  • harass, threaten, abuse, or impersonate other users;
  • use the Service for spam, unsolicited mass outreach, or unauthorized advertising;
  • upload content that is unlawful, defamatory, obscene, hateful, discriminatory, or violent, except where strictly necessary to describe an incident;
  • interfere with, disrupt, reverse engineer, or attempt unauthorized access to the Service, accounts, systems, or networks;
  • use the Service in a way that violates export controls, sanctions, privacy laws, criminal laws, or any other applicable law;
  • collect or scrape personal data of other users without a valid legal basis.

9. Location, notifications, and device permissions

Some features depend on device permissions and third-party services, including location, notifications, camera, microphone, background activity, mobile connectivity, operating system policies, map services, and push services.

If you deny or revoke permissions, some features may not work correctly or may be unavailable.

Location and notification delivery may be delayed, imprecise, or unavailable due to device settings, poor signal, battery optimization, operating system restrictions, or third-party provider failures.

10. Safety-related limitations

The Service is intended only as an additional coordination and communication tool. You acknowledge that reliance on the Service alone may be unsafe.

You are solely responsible for assessing whether to rely on information received through the Service and for taking appropriate action in your circumstances.

11. Moderation, suspension, and termination

We may investigate misuse of the Service and may remove content, limit functionality, suspend, or terminate access to accounts or groups that violate these Terms, create risks for users, expose us or others to liability, or are otherwise harmful to the Service or community.

Where reasonably possible, we may provide notice, but we may act immediately where necessary for safety, security, legal compliance, or abuse prevention.

12. Account deletion

If your account was created in the app, you may request deletion of your account and associated personal data through the in-app account deletion flow and, where provided, through our web-based deletion request method.

Deletion may be subject to reasonable verification and to any retention we are legally required or permitted to keep, such as security, fraud-prevention, tax, accounting, or legal compliance records.

13. Intellectual property

The Service, including its software, design, text, graphics, logos, trademarks, and other materials, is owned by us or our licensors and is protected by applicable intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose.

14. Third-party services and app stores

The Service may depend on or interoperate with third-party services, including hosting providers, email providers, map providers, push notification providers, payment providers, mobile operating systems, and app stores.

Your use of the app may also be subject to the terms, policies, and technical limitations of Google Play, Apple App Store, your device manufacturer, and your mobile carrier.

We are not responsible for third-party products or services that we do not control.

15. No warranties

To the maximum extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis.

We do not make any express or implied warranties, including any implied warranties of merchantability, fitness for a particular purpose, availability, accuracy, title, or non-infringement.

In particular, we do not warrant that:

  • the Service will be uninterrupted, timely, secure, or error-free;
  • notifications or incident messages will always be delivered or seen;
  • location data or mapping data will be accurate;
  • any user, volunteer, coordinator, or third party will respond to any request for help.

16. Limitation of liability

To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, business, opportunities, or anticipated savings arising out of or related to the Service.

To the maximum extent permitted by applicable law, our aggregate liability arising out of or relating to these Terms or the Service will not exceed the greater of:

  • the amount you paid to us for the Service during the 12 months before the event giving rise to the claim; or
  • EUR 100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including, where applicable, liability for intentional misconduct, fraud, or liability for death or personal injury caused by our negligence if such limitation is prohibited by law.

17. Indemnity

To the extent permitted by applicable law, you agree to defend, indemnify, and hold us harmless from and against claims, liabilities, damages, losses, and expenses arising out of or related to:

  • your misuse of the Service;
  • your User Content;
  • your violation of these Terms or applicable law;
  • your infringement of any third-party rights.

18. Consumer rights

If you are a consumer, nothing in these Terms limits any mandatory consumer rights available to you under the laws of your country of residence.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

19. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we may provide notice through the app, by email, on our website, or by other reasonable means.

The updated Terms will become effective on the date stated at the top of this page. If you continue using the Service after the updated Terms take effect, you agree to the revised Terms. If you do not agree, you must stop using the Service and may request account deletion.

20. Governing law and jurisdiction

These Terms are governed by the laws of Poland, excluding conflict-of-laws principles, unless mandatory law in your country of residence provides otherwise.

If you are a consumer resident in the European Union or another jurisdiction with mandatory consumer protection rules, you may also benefit from any mandatory rights and protections granted by the laws of your country of residence.

Any dispute that cannot be resolved amicably will be submitted to the competent courts determined under applicable law.
